Terms of Service

By accessing or using Developer Genie (the "Service"), operated by ERA Development LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

Developer Genie is a professional real estate development analysis platform designed for use in Miami-Dade County, Florida. The Service provides pro-forma modeling, IRR analysis, Miami 21 zoning compliance checks, market intelligence, and related tools for real estate developers and professionals.

The Service is intended for professional use only. All outputs, calculations, and analyses are provided for informational and planning purposes and do not constitute legal, financial, or investment advice.

You must create an account to access the full features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts that provide false or misleading information.

Free Trial: New users receive a 7-day free trial of the Pro plan. No payment is required to start the trial. You may cancel at any time before the trial ends without being charged.

Pro Plan: After the trial, continued access requires a paid subscription at $99/month or $799/year. Subscriptions are billed in advance on a recurring basis.

Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.

Payment Processing: All payments are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Reproduce, distribute, or resell any portion of the Service or its outputs without written permission
• Attempt to reverse-engineer, scrape, or extract data from the Service in bulk
• Circumvent any access controls or security measures
• Share your account credentials with third parties
• Use the Service to provide competing services to third parties

The Service, including its design, software, algorithms, data models, and content, is owned by ERA Development LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own professional purposes during your subscription period.

Property data sourced from the Miami-Dade Property Appraiser is subject to that agency's terms of use. Miami 21 zoning data is sourced from the City of Miami and Miami-Dade County.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED.

All calculations, pro-formas, zoning analyses, and market data provided by the Service are estimates based on publicly available data and user inputs. They are not guaranteed to be accurate, complete, or current. Users are solely responsible for verifying all information before making investment or development decisions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEN ADVISORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.

Our total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless ERA Development LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
